yes .. assuming you informed them that you intended to return to work before you went on Maternity Leave, and have not told them otherwise, they must allow you to return to work.

They do not have to keep your exact same Job 'open' (although a lot of Companies do) - they only have to offer you a Job that is 'Equivalent' to the one you had when you went on leave.

If they offer you something other than your old Job, it is up to you to decide if the Job is 'Equivalent' - if you have any doubts you could tell them you will do it on a 'trial basis' (usually 3 months) so you do not loose any rights.

If they say 'no' to a trial (or you decide it's not suitable), then dig your heels in for your old job back.

If you return at the end of an approved FMLA or pregnancy disability leave (leave laws vary from state to state, so check on what this means for your situation), you must be returned to the same position, or to a position that is equivalent in pay and status to the position you held when you left.

There are some exceptions - for example, if the company goes through a significant business downturn and closes a site or has huge layoffs, you may be in the layoff pool along with everyone else. However, this situation is pretty rare.

Check your company's and state's family leave regulations for more information. And congratulations on your new addition!
