No, he isn't hurt. I don't know what breed he is (or if he's a mixed breed) but the problem is just weak cartilage in the ears. Some breeds, especially the larger ones, will have droopy ears when they're young but they will straighten up as they age. Or, he may be part lop. Either way, if the ear is clean, shows no sign of injury and your rabbit doesn't mind it being touched, you don't have anything to worry about.

How old is the rabbit? What breed is it? Lop breeds have ears that droop down as they grow up. (And sometimes only one will hang down and the other stays up!) But if you have a rabbit whose ears should be up, I'd have him checked for ear mites or an ear infection. Either one could cause enough pain or discomfort to make the ear hang down.
He could have injured the cartilage at the base of the ear and that will probably be permanent. In that case, you'll have to get used to his little lopsided look!

it depends on the breed. lop breeds ears will stand up untill a certan age then they flop the the sides.

if they are just laying back then no its normal for them to lay them flat some time.

make a noise and if it doesnt rise or is still down in a couple of days then get a vet to check it out just in case.
