Dear Sirs,

Whether we can put the condition in appointment order, when an employee resigns service, he has to serve the notice period of 90 days and surrender of Leave or payment is lieu of notice pay is not acceptable.

Kindly educate and advise me.

Conditions similar to those mentioned are in existence in many MNCs. It largely depends on the Employment Policy of the Government of your country. Best way is to consult a specialist lawyer, because if you read the laws / acts and try to interpret them your way, you are likely to make mistakes. May be costly mistakes, as the issue is sensitive.
