Who should decide whether a piece of code has to run in kernel space or user space?

Well I would say the server administrator, he is the one who will have to keep the server running! Code run in kernel space can kill the entire system so the person who has to assure the system runs should be the one to decide.

Unless you own the server you probably wont get the choice.

the way you run kernel space program and user space program are different
you use insmod .. to insert a module in kernel
