There are several things that might keep you from making the minimum wage, 1. if you receive tips 2. if you are underage. 3. if you are an undocumented worker. If you are not in the above three groups, then you should have a case. I'd go to the EEOC first, before going to a lawyer.

ey are a government agency that is tasked with looking out for the rights of the employees.

Here is there webaddress
http://www.eeoc.gov/

If you come to this map and click on your state it will tell you the local branch, and give you their contact information

First of all, are you in a situation where you can recieve tips. If you can you don't actually have to be paid minimum wage.
Secondly, if he is paying you less than minimum wage and wont speak to you about it, speak to a lawyer about it. Make sure you have kept all of your pay stubs and any evidence that you have been paid less than is legal. Show them to a lawyer if you think you have been cheated, they can give you the best advice for your situation. (If your employer is found in the wrong you will recieve back pay and possibly damages etc.)

In many states, what the employer is doing is not only wrong, and a violation of your employment contract, it is a crime. You can call the state office that deals with employment law in your state, or get a referral out of the phone book > the front section of most city phone book has a listing for federal governmental agencies. Look under "United States--Department of Labor--Division of Wages & Hours". And no, they can't fire you for contacting any of these agencies. It is considered "retalliatory discharge", and that is also a crime, and makes the employer liable for large fines, and you entitled to damages.

File a labor case against your employer to abide by the Minimum Wage Law so that you will be compensated retroactively from the commencement of your employment.

are you a waiter/waitress or pizza delivery driver or someone that gets tips? if so, then they dont have to pay to min wage, they can pay under min wage b/c of the tips that you receive.

if not, then i would contact a lawyer. most of them do consultations over the phone, for free. just tell them the whole situation and they will give you advice on what you should do next.

Go to your nearest Employment Security Commission and report your employer. They will file a claim for back pay also...

I would threaten to sue the company and if they don't raise your wages then you really do sue them because they are violating federal regulations.
