Does a U.S. Citizen have the right to have their spouse in the U.S. after having entered illegal? Should they have a punishment for that even if they already applied for residency?

Now that's what I thought, that I would have the rights to have my spouse here even if they are illegal. I have put in all the appropriate documents and I am still having a hard time. My spouse isn't a criminal, he's a loving husband and father, and he is devoted to our business. He's not a criminal just because he crossed a line. He should have the right to be here without the fear of getting deported right?

Jan: But this is supposed to be a free country and I'm a U.S. Citizen, therefore I should have every right to keep my spouse here!!!

Yes they have that right but they still have to file the required petition. Also, if the spouse was put on the 10 year ban, they would have to wait that 10 years...

It takes a good 5 years and thousands of dollars to become a citizen. even if your spouse is a us citizen. you have to proof that the reason you married that person is because you care for him/her not just because you need to get your green card. The government is not stupid. They know what everyone is up to. They will find out if you are telling the truth, they have their ways. Just make sure you are not wasting your money, your time and their time.

Technically, when you marry your spouse, I believe they are instantly a citizen. There is still paperwork which must be pursued in order to finalize everything, but they will not deport your wife/husband, even if they were here illegally. As soon as you get married, they are no longer an illegal.

no. illegal is illegal. But if the spouse is a legal citizen, and marries, besides a stack of paper work, he/she is a citizen by marriage and should not be deported.

I think you have to file a I-485 application for adjustment for a spouse by a US citizen. See an immigration lawyer.

He broke the laws of this country by sneaking across the border illegally,therefore,he is a criminal.
He has the right to be deported.

A US citizen can already petition his spouse to America by presenting the necessary documents proving their marriage.

No alien has a right to come to the USA. It is a priviledge subject to certain qualifications.

I think that should be a lifetime bar to re-entry for anyone found to be in the USA illegally.

All he has to do is do it properly, it maybe a harder way, but one right equals a dozen or more wrongs.....Good Luck !!
