My boyfriend and I have been renting this house for over a year. The dishwasher went out. Isn't this landlord required to fix it or replace it?

ladybug; I'm sorry ,but my pc crashed and I lost everything I was saying to you but here goes again:
the LL has to keep all the appliances in adequate working order as this was what you rented at the time of the agreement!
He also must maintain all heat, water, windows & doors, roofs, plumbing & electrical throughout the entirety of the rental agreement. If he faulters, hes not only in violation of the law, but his rental agreement to you through federal & state laws whether he put it in writing or not!
additionally; you may, after giving ample notice to the LL that you will be fixing same and deducting it from the rents due forthwith!
coupled with that; he may not evict you from the premises if you are on a 30day rental agreement for same as that will be 'retalitory eviction', and offence a LandLord does not want to deal with, but do try to get away with to a novice!
So, go for it and get your appliances in order and live the life you chose to live and are paying for.

If you rented the house and the use of the dishwasher was included in the rent then the landlord has an obligation to fix it. Failure to fix it is a loss of service. You could give the landlord a thirty day notice to fix it and if he did not do so then fix or replace it yourself, and charge the repair or replacement off as rent. All of this, however, must be in writing and acknowledged by the landlord.

no the landlord cant remove it if your still under the lease.
unless it was stated in the lease that he wouldnt fix anything.

another question would be have you contacted the landlord about this?

If your month to month then he would have some room to wiggle out of fixing it. (30 days) he could fix it and raise your rent to cover the cost of replacement. (this is what i would do if your lease was up) first step is to send him a letter stating that it does not work and would like for him to look at it. everything should be in writing for your sake. if you replace a dishwasher it becomes a fixture of the house and you would have no legal right to remove when you left. (say if he didnt refund you) Giving notice for anything you want fixed and removing it from the rent is not the proper way tho courts have sided with the renter when the renter gave the landlord ample time to fix it.

It depends on whether or not you live in a state that has decent renters protection by law. I took a landlord to court here and the judge said I was wasting his time and if I didn't like the apartment I should move.

So go figure.

By the way. The landlord reported me to the local renters association for trying to make him fix a place and it cost me "5" non-refundable security checks at $25 bucks apiece before I found someone who would rent to me again.

it's part of what you rented, there for; he either fixes it; you pay to fix it if he doesn't within 30 days, then deduct the cost from your rent and turn in a copy of the bill; or take him to small claims court for breach of contract, if he gets pi$$y about it. contact your local housing authority and find out what tenants rights are in the state/city where you live, and go from there. good luck, hope this helps.

Dual is wrong. When you rented the apartment, you rented the dishwasher. He has to fix it. It's no different than a stove or refrigerator.

yes i work with rentals all the time and most lanlords will buy a new one, if they don't report it.

No..it's an amenity...the land lord can just remove it all together and that would be that.
