Today, as I washed my truck at a local car wash I stepped on the drain cover that runs underneath the vehicle I fell into the dirty water and have a bruised hip. Ok a man saw me & helped me back to my feet. Now this is the weird part about 7 years ago a similar thing happened to me at yes the same car wash. Should I retain an attorney and sue?

Concrete that supported drain cover gave way as I stepped on it walking around my truck. Concrete support crumbled causing drain to fall into water.

The first question you asked is "can" you sue the business. The answer is you can sue anybody anytime for anything, real or imagined. Whether you win the suit is another matter. Last you asked "should" you sue. That depends on how badly you were hurt, have you lost any work time, or doctor bills over the fall. The thing is, the place is required to have a drain in the place, and you would probably be expected to take reasonable care not to step in it and fall. Also, since the same thing happened previously, you should have known there was a risk. My opinion, for what it's worth, is you "can" sue, but from your description, you came to no harm other than a little wetness, and you were washing a car. What did you expect?

Sueing seems a bit much in this circumstance. You may have had a similar injury in the same location, but is it owned by the same people? Did you report the injury the first time? Did you report the injury this time? To your knowledge, has anyone else had a similar experience with this drain? Did you incur medical cost as a result? What was your economic injury?

Just ask for the owner and tell him/her what happened. If you are unsatisfied with the response, report it to a county safety official or BBB rep. Maybe file a complaint at the AG's office for hazardous business practices or the health department ('cause that water sounds like an outbreak waiting to happen).

Can you sue? These days the answer is always Yes. If I were on the jury and the facts were as you have stated, I would vote in favor of the car wash.

You can sue a stuffed turnip if your heart desires, but should you do it or would you win are totally different.
You have no actual damages - you got a boo boo. Suck it up and move on. Sounds to me like you need to start using the automatic drive thru kind of wash.

You probably could since people can sue for everything these days. I heard once someguy tripped and bumped into a woman by accident and he got sued and fired from his job for sexual harrasment. Screwed up right

Well, I think the right thing to do would be to call the owner. Tell him or her that you agree not to sue if they get it repaired right away. Check back. If it isn't repaired, sue away.

Please tell me you aren't serious. Even if you could prove that you own clumsiness wasn't the cause of the fall, just exactly how much do you think a bruised hip is worth?
