If the divorce was not finalized prior to death then it never will be. Unless there are unusual laws in your jurisdiction the deceased's estate is responsible for his debts and final expenses. The widow is not personally responsible, the deceased's estate is. However, without a Will the widow would stand to inherit all or most of the estate so it might amount to the same thing. The important difference would be that, if there are insufficient assets in the estate to pay the debts, and they are not joint debts for which the widow is also liable, the estate's insolvency does not automatically make the widow liable for the debts. Check the law in your jurisdiction (state/province) to be sure.

A divorce lawyer would have the answer you're looking for. Lots of lawyers do free consulations. Phone around and find one. Might as well go to the horse's mouth for accurate info.

No final decree of divorce, they were never divorced so the present wife gets the bills and expenses...unless he changed his will during divorce proceedings.
