I was disqualified bc i was incarcerated for 30 days and couldnt show up for work. What can i do to get my benefits

You can appeal up the chain of command, but I dont think it will do much good. Technically companies actually fund the unemployment, the govt itself is just the delivery mechansim (and they arbitrate between the company and the former employee).

Companies will generally only pay unemployment if THEY terminated you because of layoffs. If you quit them (and even though you couldnt come to work, that is still your fault, not the company's) ....why should they pay you unemployment...you quit them (by getting thrown in jail), they didn't quit you.

You can appeal, but I doubt the unemployment office is going to see it your way.

I dont know NJ law, but I would say that jail time probably does disqualify you from benefits. I'll bet they said you werent fired, instead you resigned because you abandoned your duties. Not showing up for 30 days could be considered "abandonment of job by employee".

noledgegod 2001,unemployment compensation is to help&aid you to get another job,you must be available to go to work if an opportunity becomes available.While you were incarcerated you were not available to go to work so you were not elegible for benefits.Now that you are out of jail reapply and start over.
