I am buying a property. I am already pretty familiar with the property. It is a duplex, and there are already two tenants who live in the home. the tenant on the second floor is fine to rent to, but wish not to rent to the tenant on the first floor. The current owner has no lease with either tenant. How am i supposed to evict her legally when i close on the property if she has no lease, and i want ehr to move as soon as possible.

Assuming that evictions without cause are even allowed where you are, you aren't going to able to start the process until you close because up until that date because ... you aren't her landlord.

Your really should be asking a good landlord/tenant lawyer in your area this question.

depends on state law.

in MA, and RI, I know that if she is a tenant at will, you need only give her 30 days to vacate the property. if she refuses, you will need to get a court order to evict her.

I would check with local authorities. You ahve the right, but if they want to stay they can stay without being chucked out. You may have to take them to court if they won't move and that could cost heaps.

Have you told them you want them to move?

you need to give them a thirty day notice, Since you just bought the property you have no contract with them.

leave a note saying that they have a cirtan amount of time to find new housing. you cant tell them and expect them to leave the next day.
