Defendant owed me money ($142) for 5 months...

I told him I was going to take them to court if they didn't pay by the end of the week, and told him that there would be court costs ($52) in addition to what was owed to me if I filed...

2 weeks after I filed he wants to send me a check, but is PO'd that I want court costs...

What can I do?

Tell him to pay up or you will refuse the check and go to trial. I'm sure he will change his tune once he realized the damage that even a small judgment like this can do to his credit rating.

If you have already filed, you are owed the filing fee. If not, you cannot add fees to your debt unless it was agreed beforehand.

If you have already filed and do not recieve your money, continue with your claim in court.

Charge him the court costs, and if he doesn't want to pay them then refuse payment and proceed with small claims court.
