You really should talk to a lawyer about this one. Many lawyers will talk to you for free before they decide if the case is worth prosuing. Make sure you have a professional take a look at your animal and keep all the paper work you have as proof that the product caused harm to your pet.
BUT....I'd be careful about what you say about the product you suspect killed your pet. Let's say you do sue and and you do not win. If you go around telling people that a product killed your animal and the courts say they do not believe that....the makers of the pet product can turn around and sue you for making a false claim.
If you are serious about taking these people to court, make sure everything you do from here on out does not come back to bite you in the butt!

Yes, The company has a very good chance of losing a case against you if you decide to sue, which you should...They could be sued for falsestatments, fraud etc... You could probably get them to pay all the court fees, the gas money it took you to drive to court, the fee of how much the animal, the cage, the feed, the bedding, a few hundred or thousand for the loss of your animal and the trouble you had to go through-- and how much the product cost-- you could pretty much justify why they have to pay for all of those and get a good deal of money.
However you are going to need proof, the can ( box or whatever the product was in) WITH the lable on it so you can show where it said it was pet-safe... you will possibly need pictures of your dead pet or bring in the cage as proof the pet ever existed... and a witness (husband, child, mom, dad?)

Sorry for your loss.
Remember, you can sue anyone for anything nowadays, and a lot of the bigger firms will usually settle out of court to avoid publicity etc.
Come up with a reasonable amount, nothing to extravagant and sue them for 300% of that, then settle out of court for the reasonable amount you truly had in mind. (They don't want negative publicity, that is your real weapon).
But, if you used the product incorrectly, have integrity and don't sue, but if you used it properly and you lost your pet, I feel your pain and think you are entitled to restitution.
Pets are like people nowadays, people are even insuring their pets.
And I agree with the others, please post the company and more details so we know how to avoid your unfortunate loss.

Sure. Can you afford to win? Probably not. Would the end justify the means? I doubt it. You would be throwing money away.
