I am outraged. Ok, a little background... My father was convicted of child molestation in 1996. He spent 3 months in jail and got out with 9 years probation. Since then, around 2005, my brother gave my father temporary custody of his 2 sons, both under the age of 5 at the time. Now, my brother has allowed my father to legally adopt one of his sons. He is now in the second grade, i think.
My question, which may be a legal one, is how in the world did they do this? Why would the state give custody of a child to a man with a criminal record such as he has? and why is he not required to register as a sex offender or predator? I have tried to locate the court papers where he plead guilty and served his conviction. I do not understand how such an evil human being can get ahold, legally, of another child that he may hurt! Please help if you have any insight on such a thing. I haven't had anything to do with my father for 11 years and no longer speak to my brother. I need some answers pls.

I know first hand that my father was guilty of this because I am one of three girls he has molested. He has been lying to my brother and saying he only plead guilty to the charges to get a lighter sentence instead of fighting it out in court. So even though he has seen the papers, my brother still doesn't believe me. He is close with my father. This is why he trusted him to have my nephew.

And then also why would your brother allow him to have the kids and allow him to adopt.

It appears it was an adoption which was done between family members, the childrens mother and father would have had to agree to it. It is very possible since it was not done though the foster care or the state, they did not require a background search on the father who was adopting.

wow, that's messed up! Sex offenders have more potential to commit the same acts when they have access to children...your brother is being so stupid! But then again, I only heard your side of the story.

Contact the local district attorney where your father lives.
