In jail you have no rights. However, most Jails and Prisons in the U.S. are non-smoking facilities because they're government institutions.

Jails are starting to become smoke free as the trend increases. There still is the faction that feels that cigarettes act as pacifiers for the general population. It may just make cigarettes more valuable in jail, they can get drugs in.

I think it's smoke free. My brother was in jail and cigarettes were only allowed in the out door smoking areas.

I have been told that prisoners do drugs in prison. Just a thought if the prison is smoke free does that mean nobody ever smokes while some prisoners do drugs?

I'm not sure about other states, but washington state you cannot smoke inside any building (that is not your home) and smoking in prisons and jails is banned.

More and more jails are becoming smoke free zones. They are considered public buildings and in most states they are no smoking zones.

From what I understand in Texas, cigarettes are banned in prisons so that's not a problem. I don't know about anywhere else.
