hi my parents and her neighbours are having problems with a tenant who is abusive and has also attacked one tenant, this problem has gone on for years yet the housing association say there is nothing they can do police have been called on several occasions and they to cant do anything , the problem is so bad many tenants are scared to leave thier homes. they have contacted thier mp but again nothing is being done ... the tenancy agreement states you are not allowed to harass or intimidate , threaten or asault other residents otherwise you can be evicted , but the housing association say they cant evict although they know what is going on basicaly they wont do anything at all ! can anyone offer me some advice.

all the neighbours have complained on a regular basis to the H/A and the police the H/A just say they cant do anything and when the police arrive the guy just refuses to answer the door. the H/A have been and spoken to this person and wrote to him but the problem continues and they say they cant do anything at all about it.

States attorney file a complaint.Get a lawyer.If he touches any 1 he can be arrested for assault.Get a report.

I would take the Police Officers of 30rs. and also with hold any rent monies until the problem stops. That is if you are renting.An attorney MUST handle the rent funds. If everyone would do that the HA would do something when the money isn't rolling in. I know you can do that if repairs aren't done in a reasonable amount of time. Is there an office in their town that handles Senior abuse? That is if they are Sr's. At last resort I would move them out. Even the Law says you have a RIGHT to a peace-full, enjoyable living condition. Check the lease it usually states something like that . If it does then the HA is in breach of contract if they don't fulfill they're Legal Responsibility. Contact Legal Aide and they will send you information on Landlord/Tenant rights. Hope all works out for them. I can understand the tenants not wanting to get involved..they are truly afraid.

What total rubbish. Of course they can do something. (in English Law that is).

When leasehold apartments come into being, there are three bodies involved. The freeholder, who owns the exterior of the building and the land it stands on, the leaseholder, the person who leases the inside of the apartment, and the management company who enforces the terms and conditions of the lease and the covenants therein.

I am the management company for aprox 800 apartments and there are things you can do.

the management company are obliged to act if complaints are made. in the first instance, they must write to the owner of the flat (which isn't necessarily the occupier) asking them firmly to ensure that no further breaches are made. if this doesn't work, the police should be approached as many times as necessary (along with the local council) to obtain an asbo on the perpetrator. If that doesn't work, the management company then has a right to apply to the court for reposession of the flat due to breaches of the lease. you and your fellow sufferers MUST keep a diary of all events. attacks, calls to police/council/management company etc, copies of any letters etc in support.

the management company has to write to all the owners of the flats to obtain their permission to take it to court and obtain an undertaking that they will pay their share of the cost of engaging a solicitor to act.

Unfortunately, English law does (a) take a hell of a long time and (b) tends to be biased towards tenants, however, if you keep pushing and the person realises you're not going to roll over and they may lose their home, they may well back down or sell.

your housing association is full of s h i t. If they know someone is breaking thier lease, legally they have the right to evict the person.

One thing I would suggest is have as many neighboors as you can muster sign a an affadavit stating that this particular indivdual has created the following problems, and hire an attorney to sue him and the housing association.

Along those lines I would also send a formal notice to your housing association that you plan on taking action against them if they don't evict this clown.

If you do all that you can contact your loacl PD and advise them of the situation and see if they can post extra patrols in your area. Best of luck.

It appears that the true problem is the tenants don't want to get involved.

Threats and assaults that occur outside the presence of the police tie the hands of the police. These offenses are misdemeanors and therefore must be committed in their presence.

The solution is that when a threat or misdemeanor assault occurs, call the police, file a complaint, and then file for a warrant of arrest.

The bad neighbor will get it through her head then that you won't tolerate her illegal activities!

If the property is owned by the Housing Association and they have failed to carry out their own rules, the Local Authority should be contacted and their Legal Department should act in your interests. I am verty surprised that the Police have not put an ASBO in place,
