How much jail time might someone get for failing a drug test?
My boyfriend just got back from prison in august of 2006
He was charged with possesion of a controlled substance, (meth), he was told he could have up to six years but only spent 6 months in the idaho department of corrections. He recently took a drug test and failed for meth and marijuana, Im guessing if he gets sentenced this time around it will be more than just 6 months, seeing as how he has spent time already. He is 20 years old and this has been the only problem on any criminal records so does anyone have a guess on how much jail time he could be facing?

wow sounds like a great guy. For sure marriage material! why do you care, dump the guy. He is only going to get you in the slammer too.

for failing a drug test for meth he could get up to 10 years in prison---not just jail. Was that part of probation?

He is likely to spend the remainder of the 6 year sentence in jail - as it should be. They gave him a chance and he blew it. My suggestion is to get his *** to the nearest inpatient rehab and make it at least look like he's trying to change.
My second suggestion: get a new boyfriend, this ones a dud.

Tell him stay away from friends with drugs, and stay out of the law hands for at ten years, drugs is a dangerous thing to have in one possession. if he don't change then you more on.
Law decide jail time not us.

He basically broke the conditions of his parole. He is going away for a few years sorry to tell you.

He should have known this before he started using drugs again.

He could get minimum or maximum, depending on the DA. If he were here in Humboldt, the DA would slap him on the wrist and let him go.

if he was on probation it depends on the judge im guessing a year to 2 years

I believe it goes 2=6 yrs if that was what they gave him.

He may have to finish the rest of his original sentence. That's what happened to one of my son's friends. I'll tell you like I told my son,"cut him loose!" Eventually he will bring you down with him.
