How much do I need to drink to be considered DUI? I am 21,5'8 and weight 140lbs.Ive been drinking for pretty long time,so I can drink 12pack of beer and still be alright but I heard that body tolerance changes but blood concentration doesnt is that true? I live in Cali by the way where ALC is 0.08%.

Based upon your weight....two beers would be close to putting you at the legal limit despite your "tolerance" to drink more before YOU think you're intoxicated.

Don't forget that alcohol is a central nervous system depressant which dulls your ability to think clearly.

Best wishes.

Not to pick on you, specifically, since this question comes up often enough, but...

Instead of asking a question like this (basically, "what can I get away with?"), shouldn't you be asking what's the prudent thing?

My read of this is that you're looking to drink 12 beers and then drive. Sorry, but 12 beers is not acceptable for anyone to drink before getting behind the wheel.

May I make a polite suggestion: get some help. If you've been drinking "for a long time," and you're only 21, and you can drink 12 beers and still be "alright," you may be an alcoholic. Or, if not yet, you're definitely on your way.

I'd hate to have you driving in my neighborhood. My kids mean too much to me to trust that someone like you isn't going to kill them.

It's sad that you're only 21 and already have been drinking for "a pretty long time". However, you can probably metabolize about an ounce and 1/2 of 80 proof alcohol and hour and be considered safe. But that is about your limit and its not worth testing that. The police and judicial system don't care how well you can function while intoxicated. They go strictly by the numbers.

you've answered your own question. anything above .08 is considered DUI. The fact that you can drink a 12 pack and be fine is irrelevant. You don't have to be driving recklessly to be over the limit.

You shouldn't be drinking and driving anyway, however you already know that, and I hope your not. I wouldn't you to kill somebody to learn the hard way.

The test they give you measures the concentration of alcohol in your blood. It has nothing to do with your personal tolerance for the effects of it. One person can be stumbling drunk on one beer, which probably wouldn't make them legally drunk according to the test. Another person could be way over the limit when tested, but appear to be acting quite normal. 12 beers makes you too drunk to drive anywhere.

5'8" and 140? I'd gamble and say 3. It goes by body weight not tolerance. You lose .02 (i think) every hour of non-drinking.
