No its not illegal except for the wearing of helmets and construction of m/cycle most laws refer to the rider and in thirty years police service I never heard of a law covering that but if he didnt behave he could be arrested for drunk and disoderly or other public order offences.

can you tell me where you would get an intoxicated pillion from ? if you mean pillion rider then i think the answer is yes it is illegal if it isn't then it SHOULD be

yes, if the passenger is a danger to themselves as well as the rider of the bike
