Be safe and call the police. I know it is sometimes an inconvenience, but I've had an experience where my wife decided not to call the police and we are still having a battle with the other insurance company. Even if it is 100% obvious that you were not at fault, get the police to come out. Also, take pictures with a 35mm camera (that you should always have in the car).

1st: exchange insurance info, names, license info.
2nd: Call the police and tell them where you are, what happened and how bad
it is--is an ambulance needed.
3rd: Call your insurance company and tell them what happened and what the
police have to say.
4th: Call your lawyer if you feel it is really important--ex. charges laid. They take
the simple things as well as the hard stuff.
If by any chance you have your camera with you, it might be a good idea to take
pictures of both cars and even the people involved. Take a picture of the
license plate, too. We always carry a small camera in our car in case we need
it for anything.
I hope this information helps you. I hope you never need it.

if anyone was injured or death in the said accident due to your negligent driving they can be filed police compleint against you vide IPC sec-279, 337 ,338 and mv act sec-177,184 in the police station where the accident has been occured, not only that but they also can be filled the suit for copensasion as per motor vehicle act sec-166,140. so i think if the coplaint has been filed by them, then you have to appoint advocate to get beil from the court and if the suit for compantion has been filed then you have to defend it through your advocate
