We own our house outright and are living in it. Next door to us there are a couple who have rented the house from their landlord. They asked their landlord for a new fenceline between our houses. The fenceline is neither damaged or old and the landlord wishes to go ahead with it. They sent us all the details except the problem is they want to demolish high shrubbery and cut off a piece of land which belongs to us. We told them that area is part of our land but they are not listening and on top of that they wish to make us pay for half the fenceline even though we aren't in need of one.
What should be done and do we need to pay for the fenceline even if we don't need it???

They can't make you pay for a fence they wish to erect. They can't cut your shrubs, and they can't encroach on your property to do any of this. It's probably worth the money to take a copy of your most recent survey to an atty and have them advise your neighbor of what rights they don't have to condem your property without your permission.

No one can force you to pay for anything like a fence between your homes whether it's needed or not. I would if necessary, hire a surveyor to come out and clearly mark you property lines if there are no markers now. If you do have markers, put up a line between the properties and if they move it, go to your local County Judge and tell them of the infractions. The County Judge is responsible for these kind of problems in most cases.

Under the Civil Law, your neighbor can only build a fence over the area of the land belonging to them. They cannot force you to give a share of your land and for the amount of cost of the fence. However, they can remove shrubs from your land that occupies their land.
