Depends on which state you're talking about - some check, and some don't. If yours does, and if they're really bad (not just a little soft), then you'll probably fail.
Either way, if they need to be changes, then do it. Shocks aren't just for comfort - they also help keep the tyres in contact with the road when driving over bumps - so the car turns and stops better.

If they are not bad enough that the technician will notice... i.e. the car bounces alot as you/he pulls it in. maybe. but do yourself a favor and don't try to cheat the system... safety inspections are there for a reason. get the shocks fixed

If the mechanic doing the inspection is thorough, he'll pick it up, and if he picks it up... your car fails inspection.

no it wont pass and it is quite silly driving with them in poor condition.
