The rules vary from state to state. Adultery must be proved beyond a reasonable doubt, even so, this still may not be grounds for annulment in the eyes of the court. You should consult with a Lawyer.

I'm not sure you can get an annulment, divorce yes in common law. As for an annulment with the Church, that is a lot of paper work and fees, you would need to talk to your priest about that.

I live in PA and I went through the exact same thing. Unfortunately in PA you cant get an annulment you have to go through a divorce. : ( Sorry to hear about you situation. Do a search in you havent already on your state and annulments. Check the goverment sites, those are more accurate. If you cant find anything, more then likely you will have to divorce.

You can't get an annulment. You have to get a divorce. The only way you would be able to get the marriage annulled would be if you could prove he defrauded you BEFORE you were married and that you didn't find out until afterward.

If you live in the U.S. and you're talking about a *legal* annulment...
Adultery is not grounds for annulment in any state.
If you live in a state that allows ‘fault’ divorces (and I believe some states are strictly no-fault) then you can get a divorce on the grounds of adultery.

Unless you can prove one of the following:
1. He entered into the marriage with the intent to commit fraud (for a green card/residency), (for money not love),
2. He was not eligible to have married (under age), (already previously married and not completely divorced), (is really a person of the same sex as you but claimed she was a HE...falls under committing Fraud)
3. He meets the legal definition of the term(s) IDIOT or INSANE at the time he was married (not of sound mind to make decisions....maybe you or he were intoxicated, or both were...and therefore not able to make sound decisions due to being under the influence of drugs or alcohol at the time of marriage),
4. You can prove that the marriage was never "consumated" ... you did not have sexual relations,
You'll have to get a divorce (in the state of California). Talk to a lawyer (some consult for free) and see what you can do.

Talk to a lawyer. If he cheated after only 3 months of marriage, I'd say you have a case for annulment.
But I think you should sue the pants off of him for divorce. He deserves that, an annulment would be letting him get off easy.

Only your priest will know about the annulment part. You should speak to him first because I think you have to divorce first and then get annaulment done. No, he cannot tell your husband if you tell him not to. Take care Heather

Consult an attorney in your state. Many will give free initial consultation. Where I live that is not grounds for an annulment. Good luck.
