In December I was laid off from my job due because of the slow season (construction) and I'm collecting unemployment. Now I want to start my own business. But I need to tell my employer that I won't be coming back to work. I need to advertise and if he see's my ad then he will fire me and I don't think I can collect any more (something to do with conflict of intrest). I need to be able to keep my unemploment for the begining when work is slow. I am scheduled to go back to work in a few days can I just tell him that I am looking to explore diffrent oppurtinities. I don't want to leave on bad terms he is a great guy to work for and I don't want to burn any bridges in case things don't work out in the self employment world.

I don't plan on collecting the weeks that I am working for my self it's just for the weeks I am trying to get off the ground. Don't want to take out a loan because I am already living paycheck to paycheck and if this doesn't work out I am going to have to back to an hourly job.

If your old boss is a general contractor, maybe you can specialize in some sort of sub work, and ask him to throw some bids your way.

I do not think that you are trying to defraud the government, but you cannot work, and collect unemployment.
You do, however, need to tell the boss what you want to do. You may have to suck up the money for a while until you start making money. If you tell your boss, you will have a better chance of leaving on good terms.
Think about working part time at a convenience store, or something of that nature, to get a little bit of money anyway.

You could always just go to the bank and get a loan and do it the right way....
But, if this guy is such a great guy, you should just be honest with him and tell him what you are doing, but say that you would love to come back if things don't work out. If he hires a replacement, that might not be an option though.

This is called the "you can't have your cake and eat it, too" dilemna. You can't work and collect unemployment. You can't quit your job without a good reason (starting a business doesn't count) and expect to collect unemployment. You can't start a competing business behind your boss's back and expect not to burn any bridges.
You need to decide which direction you want to go in, and be prepared to take a loss of another option in order to pursue it. Good luck.
