Animals cannot be legally charged for anything because they aren't people, but if an animal kills a person then by law the animal must be put down. Murder is only the killing of a person. Killing animals is not murder.

Because, part of the legal definition of murder is knowing what you are doing is wrong. Since animals such as cats are acting on instict and cannot determine this, they should be charged with mouseslaughter. Or birdslaughter, as the case may be. Good luck with charging them, as meow is not an acceptable plea.

Many reasons.
Firstly, no human would be convicted of anything for killing birds and mice.
Second, human law pertains almost entirely to humans. Murder statures say person, not creature.
Third: Even if an animal were able to be tried, it would probably be concluded that they weren't mentally stable enough to be held accountable for their actions (like a permanent insanity defense)
