I do not want it, but will not force him to stay, but shouldn't he do the filing just on the principle??

If he's smart, he will do the filing. In filing, you state what you expect the judge to grant you. If you don't respond, the judge will give him everything reasonable.

If he's that cheap that he doesn't want to pay the filing fee, you should file and get a new man.

In some states, if one spouse leaves the marriage for no good reason; he/she has no real grounds for divorce, and will try to convince the other spouse to agree to a divorce to speed up the process. Laws regarding divorce vary from state to state, so a good attorney would advise you on what is in your best interests -- to file or not to file.

Just let him do the filing and when the papers come you sign them. Why should you have to file if you dont want the divorce... have you asked him to go to marriage counseling with you and to try to work on and save the marriage if at all possible. Why does he want the divorce anyway?

yes I agree if he's the one that wants it let him file. Unless you have given him reason to want a divorce like cheating on him then I say it should be you doing the filing.

Yup. If he wants the divorce he should be the one filing for it, as it does go on record which spouse filed for the divorce initially.

You should file first cause you will then get him on abandonment which means you will at least get half of everything. If he files first abandonment is out of the picture. And he can file anything he wants.

If he wants the divorce, he should be the one to file unless he's too cheap and wants you to pay for it.

Of course he should file. He's the one who has the grounds, he's the one that wants out. Let him have the money to pay for it.

I would say if he wants the divorce let him pay. If he has a reason he wants out then let him by all means pay. Like mine I was tried of being mistreated and I told him I was threw and I would pay for the divorce .

Yes, have him file. It will be less expensive on you unless he files for you to pay it all. Then when you fill out the paperwork make it either a joint pay or him pay all.
