no you do not have to use his choice. you use your choice of repair shops. Some states require you to supply at least 3 estimates. Ask him one more time to pay up and tell him that you have already talked to a lawyer. If he still refuses then take him to small claims court. You don't need a lawyer for this. It's really no big deal, just have ALL your ducks in a row (all your paperwork) before you go into the courtroom.

No you are legally not obligated to go to the repair shop of the at-fault person's choice. Time to get a lawyer. You might try letting the guy know that you've contacted a lawyer (even if you haven't) because for a lot of people, the words "lawyer" and "lawsuit" are enough to scare them into getting their heads out of their butts. If he doesn't budge after just mentioning it, then I'd go through with finding a lawyer.

One last note for future reference, this is why it's crucial to file a police report the moment after an accident happens. For some people, if it's nothing more than a lil scuffed paint, then sure, you can just buy a bottle of repair paint for cheap. But believe it or not, it's written law in nearly all (if not all) 50 states says that in the event of an accident, it's mandatory that a police report be filed. By doing so, you have a stronger case against the offender if that person tries to avoid paying the cost of repairs... just like this guy is doing to you. So, be it minor or major, any kind of damage should be reported to police.

Ridiculous! The kid doesn't pay for the repair, his INSURANCE COMPANY does through your insurance company. If he doesn't have insurance, he's committing a crime by driving without insurance... he could lose his license and maybe even go to jail (especially if there's a warrant out on him.)

Talk to to YOUR insurance company. They should be a referee here so you don't have to deal with this greasy guy. Use a shop your insurance recommends who does insurance work. You're entitled to a good insurance-quality repair.

Maybe "his" shop will do that. However you should presume he intends to pay for a shoddy repair on your car, until he and his shop prove otherwise... TO YOUR INSURANCE COMPANY. If they sign off on it, go for it.

In a perfect world, if the shop he's willing to pay is also a shop your insurance company recommends, then coordinate with your insurance to have it done there. But make sure insurance is in the loop and financially responsible. Insurance should pay the shop, not the kid. If the kid gets a kickback from the shop, who cares, as long as it's a good repair.

What you need is for him to admit guilt in writing in some way. (such as his offering to pay for the repair.)

His choice or yours? Neither. You are entitled to a good, insurance-quality repair. You are NOT entitled to get "Gucci" gold-plated repairs and a $10,000 paint job.

Sounds like the kid is hiding something. Maybe no insurance, revoked licencse, warrents for his arrest (really doesnt want a police report), or does not want his insurance company to know what he is up to. Hopefully you filed a police report and exchanged insurance information. This is where you put your insurance company to work since you pay them every month. Use our insurance rep to call his insurance company to arrange for 3 estimates and a settlement. It is not up to him as to how much and who fixes the damage, it is your right to have the vehicle repaired back to the condition it was in before the accident. If he does not have insurance or his company does not work with you, then like the other postings suggest, hire a lawer to help you.

tell that kid to kiss off ...go where ever you want get a couple of different estimates .sounds like he doesn't,t have a license or insurance..get a lawyer if he refuses.

I hope you have a police report of the accident, it's your choice where you get it fixed not his, he is the one at fault.
