i've been recently suspended since i was accused of taking 600 from the tills, i know i didnt take the money but they r suspecting me. There will be now a disaplinary hearing where i think i will be sacked, wot happens now, will there be a court case? will i get a criminal record for a crime i didnt commit? will i ever be able to get another job or will i be completely jobless? ive almost finished university so even with my degree will i still be jobless?

In India there are separate laws, rules & regulations for the private, Govt. Undertakings' and State & Central Govt. employees. Labour courts deal with private & Govt. Undertakings' employees; State Administrative Tribunals for State Govt. employees and Central Administrative Tribunals for the Central Govt. employees.

An explanation is usually called for before framing charges for departmental enquiry. The appointing authority accepts or rejects such enquiry report and may proceed further to exonerate or punish the employee. An appeal lies against such orders. If unsatisfied, the orders will come under judicial scrutiny when approached.

If some offence is reported to police it will register First Information Report and investigate. If the crime is established against known accused, the police files a charge sheet before the Criminal Court. After a full fledged trial, the courts delivers its judgement of acquittal or conviction. Any Govt. servant convicted for an offence involving moral turptitude will be dismissed from service and will never get a Govt. job.

Have the police been called yet and if not then there is no court case. If you are fired then apply for unemployment and nothing can go on your record except that company is not going to give you a good reference so don't use their name when applying for another job. Don't worry if you didn't do it then you will be cleared and reinstated in your job with full back pay. After all in this country the law says innocent until proven guilty and not the other way around. Hang in there and good luck.

If you are an Indian Muslim then i am sorry to tell you that the court and the system will go against you and no body cares if you are innocent or not. Better talk to the management and try for an out of the court settlement.

If their intention is to fire you, then you can not do anything. They can even frame you in to criminal case and better avoid. Request for a graceful resignation, get a good character service letter and just walk off. God bless you.

Employers don't need a just reason to fire someone, so even if your under suspicion of stealing, you can be fired by the boss. But no criminal prosecution will be taken because they can't prove anything. Pretty much the only thing bad will be that you can't list them as a reference on your new applications, which you probably wouldn't want to anyway if their that much of *** holes. Don't worry sometimes crappy things happen to good people, you will probably get a much better nicer job with your degree and run into your old boss at the mall one day in your shiny new car and gold jewelry.

Plus if your judging by your profile and vernacular, your probably a Indian living in Britain. If your really sore about it, you can claim they fired you over discrimination and sue them.

Nothing happens. You live in India where every single person is corrupt right from Prime Minster to Beggar on the street. Only degree of amount is difference. Since you did not do anything wrong leave every thing to GOD and move on. Hardcore criminals are getting elected to public positions and you are afraid of such a small thing. I would suggest you before they all this tamasha you quit job and spit on their face. These days there are no shortage of jobs for educated people like you. Good Luck

Hey Naveed don't worry !
Nothing will happen. They will send u some court notice & stuffs if u r working for a company or so. Change ur address n phone no. No body can do anything without ur address. Don't hand over ur passport or any copies of evidence anywhere. A friend of mine was under the same situation. He is fine now. I hope the same with u. Don't worry. concentrate on ur studies & fly to a different state for a new job.

Wow, sorry to hear that. It depends on wether they press charges with the police. It also depends on how much justice you can afford. The strategy with the police is to press as many charges as possible, more than they realistically expcet to win on, and then let the person accused run out of money paying lawyers, and then the lawyer tells the client to plea bargain.

It is always a good strategy to work strictly and correctly so that the accusation and suspicious fingers do not point at us. sometimes it is negligence of duty on our part that may put us in this position.
This time I am sure u will get another job, but this type of performance, on your part should not be repeated.

If they criminally charge you with the theft and you are convicted you will have a record. Do you have proof that you are innocent?

It seems that still they haven't prooved it. Forget it, they cannot sack u.

But it is my sincere advice to leave them, once u prove that u have not taken it.
