Jeremy Erskine has filed for refugee status because he doesn't want to return to the states to face his rightful charges. Why would Canada release him from detention when he is such a flight risk and escaped from jail in the first place?! How does the CIC decide such a thing?

Thanx MaryBridget G for enlightening me on this matter! From what I know of Canada's extradition laws... it just takes time for the red tape to be processed & all legal avenues to be used up for Canada to finally export any alleged criminal back to the country who asks for them. This applies esp. if the country they are to be returned to allows Capital Punishment! Canada always insures that that would not apply if they handed over a wanted person for murder.

Canada's problem is the Immigration Laws & Officials! They toss out those who seek asylum from persecution in their own country for Human rights Laws etc. & keep the drug dealers, murders, car drag racers who commit a hit & run, thieves etc.!!! And when they do occasionally deport theses criminals that have abused the kindness of this country, the deportees wiggle their way back into Canada to continue the same criminal or illegal acts, & if caught, they get to go through the same process of red tape & appeals time & time again!!! Canada needs to get it's act together & stop trying to be so darn nice to everyone! That's how I see it any how.

That is a good question. Mr. Erskine escaped from Liberty Hall in Indianapolis, Indiana in March 2006 were he was serving an 8 year term for forgery. He has not completed his sentence, and has not done the time he owes for his crimes. He fled to Canada and seems to be seeking refugee status. He has a hearing in Federal Court in Edmonton on April 10th.

It is alleged that Mr. Erskine also committed fraud, forgery, and auto theft in Illinois to aid in his flight to Canada.

Edit - I'd add that from the records and stories I've gotten from people in his case, that he has crossed the boarder between the US and Canada to evade justice before. In fact, he makes a habit of it. I was told by one of his victims that he was held in US immagration custody for a year after been caught for forgery when he crossed the border at Vancover. He ended up in limbo like that becaue he insisted that he was not a US citizen (although he is and was born here).
