yesterday my partner sat in a bus shelter and accidently fell backwards where theres usually a plastic window but there wasnt and now shes fractured her ankle but she has no witnesses does anyone think she could claim compensation

Hi i also had a simular experience with a bus stop about 8 years ago,i got off a bus and the foot which i put down first when getting off the bus there was a pot hole which my foot and ankle went into leaving me on the floor in terrible pain which also i was holding my daughter which was 1 at the time.Yes you can sue the council and you will more then likely win.I contacted a solicitor straight away,took many photos off the area and my ankle which i was advised by my solicitor to do.Yes the council will put up a fight like mine did but luckly for me i had 2 witnesses which both done a report what had happened in the case i dont think this will really matter as they will be able too see its negligance on there behalf.My case went on for 5 years,i tore the lateral ligament straight off the ankle,i needed many mths off physio then surgery and a cast for 8 wks.I still get problems now but thats something i have to live with.I had a interium payment off £4500 then another £14000 once all the case was over.If you want any more advice email me.Good Luck

How on earth did she fracture her ankle falling backwards whilst sitting down? You should tell the council responsible so that they have the opportunity to fix it, mentioning the injury sustained at the same time. keep a look out to see if they do anything, and if not, nudge them again. That's a good citizen thing to do, save someone else from a possible injury. Please don't sue, all this suing is making this country a crap place to live in.

Having seen bus stops without glass in Swindon (where it's been broken) I think the council have to put some sort of bright tape across the gap to show that there isn't a panel of glass/perspex there. If that was the case here, I doubt she would be able to claim.

Of course, you could write to the council (or bus co. if they own the stop) and ask for compensation.

I badly sprained my ankle about 3 weeks ago. I was in a hurry going down the stairs, lost my balance and landed on a bad side of my left foot, causing my left ankle to be stretched going on the inside. The first 48 hours were excruciating and the pain was un-believable. I've never had a serious ankle injury before.

So I immediately treated it using the RICE method. The following day, the bruising and swelling were so horrible. I found out that I got a second degree sprain and immediately panicked after that. I had a football game on that week and it been looking forward to it because I've been training for rt. I had teammates that had similar injuries and it took them months to fully recover, some of them stopped playing altogether. So I kinda had a short-term depression because I can't imagine myself not being able to run and play sports anymore.

Because I was so desperate to recover again, I contacted a lot of people that I know who do sports and asked them if they had similar injuries. One friend of mine, from the boy's football team in my university, told me about H.E.M. Ankle Rehab. I got a copy 4 days after I got injured. I immediately read and followed what was instructed and felt improvement on the first day. I was able to walk a bit, but I was in pain.

A couple of days after that, the swelling and bruising were subsid-ing significantly and on the fourth day, I was walking comfortably again. Although I've had felt a bit of stiffness, I continued doing what was instructed. My sister was surprised that I have recovered this fast. I told her about this book and was shocked on how effective the procedures were. I'm just so happy that this book was shared to me and how effective it is.

it was an accident!!!! i wouldn't file a claim of compensation i would just call whoever is responsible for the bus shelter and let them know there was an accident and that they should have the window fixed...

No! She fell. It's not the job of the city you live in to keep your partner's balance. She just needs to accept the situation and deal with it... not play into the "victim" mentallity that so many people in our country are fond of these days. You do realize that by sueing the city you are taking its residence's tax money? Or is that completely acceptable to you?

here's a shoulda woulda coulda for the books...like any "accident" first thing you ever want to do is call the cops because a cop is the ONLY person who can file a legal report as to what happened.

the only thing i'd do in your case is to call legal aid to see if you have a case. if you do, it would be against whoever or whatever has jurisdiction over the bus stop construct. that could be the state. in addition, whoever did the safety inspection of the construct could be liable.

Come on... it was an accident and she caused it.... at most she may be able to collect unemployment compensation for a few days if the doctor agrees that she can't work.

Well i suggest that you concentrate on helping her to recover first then worry about compensation. It has only been a day or so after all.
