My employer started reducing my hours at the end of January, of which I was notified. Since then my hours have gone from 36 hours a week to 6 hours a week without any sort of notice at all. I can go in one day and be told, "you've been cut this day, or you've been cut these hours." The reason for the cuts is because I work for a doctor's office we went electronic so there isn't a lot of work for me to do. She seems to be slowly laying me off preventing me from getting any viable unemployment compensation....is there a way to get unemployment based on pay from before the cuts if I send in 2 months of stubs? Is it legal for her to keep cutting my hours this way until (ultimatly I'm sure) laying me off? I live in Massachusetts if that helps any. I am actively looking for a job, and have been since the cuts started, but nothing seems to be working out....can she do this to me?

When I was told the first time I was told only Thurs (which was 4.5 hours) would be cut and I was given a 2 week notice for that. That have me 32 hours....
then I was told Tues would be my only full day and Mon, Wed, Fri were 4.5 hour days.. giving me something like 20 hours...
then full day tues was cut and it was all half days, and then in the same week Tues was cut all together.
I was left with Mon, Wed, Fri and today Wed went bye bye and now I am left with Mon and Fri 9-12.

You need to call your local unemployment office and ask them about your rights with unemplyment benifits. It sounds to me like she wants you to quit so she doesnt have to fire you. I would think that legally she can do whatever she wants with your hours. I dont think she has to notify you in any way. It's her practice. Just keep looking for employment elcewhere and best wishes to you.

This is a really shady thing for her to do! I hate it when employers don't take responsibility. She should have laid you off in the beginning so you could get unemployment and look for another job right away.

Unfortunately there's nothing illegal about it - just immoral. You can't get unemployment unless you've been fired, so quitting won't help.

I think you should get another job lined up, then have an honest talk with her. Tell her you do NOT appreciate the way you've been treated, and that she should be more honest with her employees.

I guess also call a fair employment office and see what they can tell you.

Is Mass. a "right to work" state? If so, they can cut your hours all they want. You are entitled to "partial unemployment". A lot of times the employer does that to get the person to quit, so they don't qualify for unemployment. I work in an unemployment office... don't quit! Take the abuse, and file for an unemployment claim.

When they notified you did they notify you of how many hours you would be working? If not as long as you have a contract you have a right to be given those hours. Your best bet is to join a union and get someone to look into it for you. Hope you get it sorted out!

You may have grounds to sue for constructive dismissal - she can't find a reason for making you redundant and would have to pay you for htis so they are trying to force you to quit. My advice would be to speak to a lawyer or an advocate and get some legal advice.
