My 11 year old son was in gym class last week and the gym teacher forcefully grabbed him by the arms, picked him up about a foot off the ground and threw him down onto the gym floor...I had a meeting with the assistant principla and teacher the next day...the teacher admitted to what he had done and they hoped that I would "accept their apology. But teachers aren't allowed to touch students at all let alone in anger...so I said no it wasn't enough. I said that I at least wanted to make sure that the teacher was written up and that it be made part of his permanent record so that if it ever happens to another student then it's been noted. They said they would meet with the main principal and let me know what corrective action they decided to take..that was a week ago and they have failed to contact me...What should be my next step??? Do I try to hire an attorney? For the assault AND for the school not taking care of this in a timely fashion...

Leogirl you sound like a very angry person who doesnt know the facts. My son is NOT a smart-a$$ brat like you seem to be..so what are you teaching YOUR kids by YOUR attitude...especially jumping the gun before you even know what happened...the teacher admitted to just having a "bad" day. Well if you or I were to be physical in that way with a child you could bet CPS would be knocking on the door. This guy is BIG and he had no right to touch my son because he was "having a bad day". So if you had no helpful info to add to a legit question (this guy broke the LAW) then you should've just skipped it.

First thing is the police for a police report then a follow up with the superintendent of schools, then on to a personal injury lawyer. The school will pay off a reasonable amount not to get the publicity and not to have to go to trial. The teacher will either be reprimanded or lose his job and very well will be charged criminally for their actions.

Edit: do not even negotiate with the Building Principal he has no authority in this matter. This is something that the school board should handle because of its seriousness.

You did right by first meeting with the assistant principal. Since you haven't heard anything, I'd suggest you contact them again and now with the head principal, and make sure he was wrote up and it'll stay in his permanent record.

I'm not big on suing, especially on such a minor case. You son wasn't actually hurt, just embarrassed. He also probably did something to escalate the situation. I know, teachers are supposed to be in control at all times, but they are human and they do get stressed out at times.

If he is written up, however, he'll think twice before doing such again, so you will have prevented the problem from happening to someone else in the future. If it's happened in the past, this will log a reoccurring situation and the school should dismiss the teacher.

I don't believe the school is allowed to disclose to you if there have been problems such as this in the past with that teacher. Personnel records are not open to the public.

I'd make sure I logged the incident, and keep your ears open. If you hear of such again, you'll have the date, teacher, who you spoke to, etc. Then you could both go to court and prove it's a reoccuring situation which the school failed to remedy.

What did your child do to get such a response? I don't think you have the full story. There is no need for them to contact you about corrective action they have taken, this is a matter of employee privacy at the school. Your next step, forget it and move on. It isn't worth hiring an attorney.

You should call the Superintendent and discuss the situation and let them know that if that doesn't work you are going to go one step ahead. You cannot neglect your child's safety, no teacher should be allowed to touch or abuse a student.
But hurry up, because you are not the one at school having to deal with that teacher every day.

Call the police.

Then call an attorney.

Make sure the media also knows about it.

No teacher should hurt a child.

I just wonder what your brat did to cause the incident. It is obvious you are one of the people that thinks their kid can do no wrong. It is curious you never mentioned any input from the father. You need to rethink your priorities.

I don't blame you for your anger
I would insist that action be taken
First go to school board or Superintendent of Schools
if that does not work
call the police and enter a battery complaint

Call your local news channels. They eat that up! He'll surely be fired due to all the scrutiny and attorneys will probably be knocking at your door. Good luck!

dont hire a lawyer, it sounds like you did enough. if it happens again, step up on what you do, but for now remember that everybody makes mistakes.

Its parents like you who reward brats to be disrespectful. I'm sure your little angel knows all your feeling and will be even more disrespectful in the future. Thank you for making it impossible for kids to get an education today because your little brat wants to be a smart *** problem child.
