i work 41 1/2 hours a week i have to take my bank hoildays out of my own hoildays i get 20 holidays a year (or somethink like that) can she do that as she is a small buiness. she thinks that she can take my bank hoildays out of my hols plz help because i dont no if she is taking the micky and giving me less hols

intresting you should say that when I worked for a small business I was told that bank holidays were part of the 4 wks holiday I was entitled to-no extra pay owed of lew days were owed to me.

I think it depends on the manager in this instance but get yourself down to the cab and if you dont get any extra for working the bank holidays then dont work them!

She knows the rules... Check out www.businesslink.gov.uk, hit the 'Employing people'option, then 'Working time and time off', read and weep... Still depends on what your written statement of employment ('employment contract') says though, if you have one of course. If you don't, did she ever say you would get 20 days + bank holidays. If not that's the end of the discussion I'm afraid.

Maybe you could suggest paid spelling lessons in your normal working hours. She wouldn't say no to that!

In law, your legal intitlement is actually only the bank holidays. Any holidays above that are at the employers discretion. In the UK, that currently means that you are entitled to eight statutory holidays. If you get 20 days, then you are actually getting a good bit above the legal minimum, even if it is less than other people get.

That is correct - currently it's 4 weeks (20 days if you work a 5 day week) minimum by law, which can include Bank Holidays.

There are proposals to change this (i.e. Bank Holidays will be 'extra' Holidays) = see second ref. below

Hi!

It's her business. She can dictate the terms and conditions of employment, as long as they are within the law.

Yep bank holidays can be included in or can be additional to your entitlement - it depends on the wording in your contact. You will have been informed of your entitlement before you took the job and signed the contract of employment, which of couse you had the choice whether or not to sign .

IMHO she is not taking the mickey!
