My friend and her husband are in the middle of a divorce, but he threw her out of the house. She's been spending the night at her friends house. Overnight, he went and took her car, so she was stranded at her friends house unable to go to work or anything. They have a joint account, so yesterday she went and took out $2500 so she can buy herself an apartment. today, he went and told the bank that she had no right to take that money, that she was stealing it from him, blah blah blah.
what's worse is they have a 2 year old daughter that he threw out with her and the daughter is staying with my friend's mother for the time being.
WHAT CAN SHE DO?! she's taking him to court to finalize the divorce and for custody of the child. but is there anything else that she can do?
Please help.

First, consult a lawyer, ask the lawyer to have her soon to be ex to foot that bill. The lawyer will advise her to her rights, her ex may have to pay her bills until the divorce is final but the judge may require her to return to the marital home. Her lawyer should fight that however as the child needs security, can't be tossing them out when he gets angry!!

As far as their personal effects, the lawyer will make certain that is in the court order and all she has to do is have the local law enforcement agency accompany her to the home to retrieve them.

The car, that depends on who is the registered owner and whether or not the state in which they live is a community property state or not... Again advise from the lawyer is needed in this matter!!

I hope for the child's sake all this works out for the best!!

Plenty, but everything with 90 days of the divorce will be brought back in. Assets and debts will be split 50/50 or close to it. Chances are, if not ruled as unfit, she will be awarded custody of their daughter, child support and the house due to the custody and possible spousal support. Now she can get a protective restraining order against him if needbe for safety reasons. He will probably get state mandated visitation rights unless you can provide a real good reason to have those visits revoked or supervised with no overnights.. Just be careful as this sounds like it could turn real nasty real quick. Good luck

She can get the police to go with her to get her clothes and those of her daughter. She can be thankful she got the $2500 before he got to the bank. Did she escape with any credit cards-she should check to see if they are still good-he may have cancelled them. If she can she should stay with someone for a while so she can get on her feet. That money wont last long. If the car is in her name she can go get it but if its in his name or both then she wont be able to. Tell her to get a good lawyer.

OK your right he is crazy but the truth is a protective order to keep him away is about it was the car in his name or hers or joint if in hers have his a-- arrested for stealing the car if his or joint that wont work but she needs to give thanks shes getting away from him he is a nut,and a sorry excuse of a father to throw the baby out too but i wouldn't have left her with his crazy a-- anyway but wow he might be a danger to her safety she needs to be very careful.if the account at the bank was joint hes screwed she has rights to the money.why is it men that spout love about their wives and children when things are going OK act like this fruit cake when they go wrong?well i guess Forrest Gump said it best stupid is as stupid does.

well if it is a joint back account, then she has rights to the money to,the bank knows that..if she got the money then get the apartment, the car if it is in her name then report it stolen, if it is in his name then can't do much, both of their names, they will have to take that up with the judge.. maybe she needs to talk to the police and see what she can do
