So, My Mom got a Dell computer through their credit service. Apparently she has been having trouble making minimum payments. She has been sending a payment each month, just less than the minimum they ask for. They are threatening to repossess the computer if she can't pay in full. I've tried to help her negotiate with them, since she has become disabled, but we're not having any luck. Will they really repossess? Any tips on dealing with them would be much appreciated.

The problem you are going to face is that there was a contract signed in which she agreed to pay a specified montly amount, with the understanding that it could be re-po'd upon breech of that contract.

Now, with that in mind, it is much more likely that they would send the account to a collections agency who would harass her until the account was paid.

How much is left on the system? Could you just pay it off and end the whole issue right there?

In my experience credit services tend to use pressure like this to get the payments. In all likelihood, it would cost them more to repossess the computer than it's worth. That is unless your mom bought some servers.

She should continue to make the payments as best she can and read the credit contract she signed. She may have agreed that if she can't make the payments she would give it back (probably in the small print).

Kill them with kindness no matter how rude they get. Keep negotiating with them. Ask to speak to a manager every time you talk to them. Write down names, employee numbers, etc. Arm yourself with information. If she is making every effort to pay them, they will not likely try to take it.

Good luck with this ordeal. Hope it works out for your mom.

I think the best way of handling this to make the minimum payments. They are demanding to be paid in full because she she has not been making minimum payments. She could try writing to them and explaining that she has a problem and request that the minimum payments be reduced to an amount she can afford.

Yes...they can repossess. That loan is a "secured" loan, which means they own it until you pay it off. I had that same type of loan thru Dell.....that's what it is...she'd better find a way to pay at least the minimum, and catch up on what she is behind in. Maybe the stress of having to try to pay it is worse than just letting them have it back....

Is she on any workers compensation or disability payment plan? If not, she should be. The credit company should also take this into account...you might want to consider contacting her lawyer and asking what your options are as far as the payments are concerned...he/she might be able to get them lowered. They definitely can reposess things is payments are not made.

another reason for never buying a dell. I would see if you can get a computer loan threw the bank. hopefully you don't have much left to pay on the computer if you have only paid 2 or 3 payments let them take it back. but make sure they sign something saying you owe nothing.

Really, all you can do is explain the situation. If the person on the other end does not make an attempt to resolve the situation, ask to speak to a supervisor. Often times they can do more for you.

she is getting called by a collector , who is using a time proven tactic of trying to scare her , trust me NONE is going to show up at your door with a court order taking back a pc , IT'S NOT GOING TO HAPPEN , the next time the debt collector calls you tell them look , we will pay you what we can , if your willing to work with us great , if not tell them you will pay when you can , and hang up on them . do not let them intimidate you . now i'm not saying don't pay the bill , but never stand for being talked to like your breaking the law

i'm sorry but if they set minimum payments which i imagine are very small and you cant meet them then they have every right to take the pc back. if you cant afford something dont buy it.

Why not lend her the money, it shouldn't be that much more that has to be payed for, computers are pretty cheap these days.
