It is the Supreme Court.

However, they are to decide if the policy, law, regulation, etc. in question is constitutional or unconstitutional. In other words, they are supposed to decide if the new policy adheres to the Constitution.

This ability, known as "judicial review" was actually not an original function of the Supreme Court as the founders saw it, since they never gave it the power to strike down a law, but gave the court the ability to voice whether they saw it as a violation of the Constitution or not! It was introduced in 1803 in the case of Mabury vs. Madison.

Supreme Court. The Senate and House of Reps write the laws, while the president would enforce, so the Supreme Court interperets the laws and Constitution for court cases to allow people to know if certain things are Constitutional or not.
