The robbery resulted in assaults on 3 of the employees. A previous manager had asked for additional security measure after other robberies that resulted in no injuries, but no additional security measures were taken. It took 3 people to get beat up for the business to add a part-time guard and bars on the windows.

Unfortunately, this is how the laws become effective. It takes for people to get hurt or even killed before something is done. The employee can not sue the employer due to that is part of the job. There was prior knowledge that a robbery had taken place and the employee had every right not to take that position. The employee was informed of problems with robberies. No one would have been able to forsee if anyone would have gotten hurt or not. There is no case here. Thank you and good luck.

There have been a number of lawsuits filed against employers for failing to provide adequate security for employees. Few of them, however, are successful, even in cases in which employees have been killed during robberies.

How successful your case would be depends on a number of factors, the most important of which is the law in your state. So, to see if you have a case, you should contact an attorney in your area.

Yes the employer has to insure your safety so the employee can sue for safety negligence if it has occured mutliple times and it is obvious that the employer has done nothing in their power to stop it.
