my name was on the lease and i was paying the rent. it is something that happened in the presence of my infant daughter. It was not abuse. Is she still allowed to secretley do that.

It really depends on the content, and what she intends on doing with the tape. If she is going to maliciously post the video all over the Internet, that is an obvious violation of privacy laws. If she is just keeping the video for her own personal viewing, there is not much of a legal issue there.

Is the girlfriend the mother of your daughter? If so, that changes the entire context of the secret videotaping, particularly if she suspects you of doing any type of questionable activity, which doesn't necessarily have to do with abuse. For example, if you are doing drugs, or watching porn, or pleasuring yourself, this could be very damaging against you in a custody case.

If her motive for the secret taping was the well-being of the child, it doesn't matter who pays the rent, who is on the lease or where it occured, it is legal in all 50 states. If you did anything illegal or inappropriate in front of or to the child, the tape can be used against you in a custody hearing.

The area of whether or not it could be used against you in a criminal procedure is a gray area, as laws vary from State to State.
