we live together but he threatens me that if i do leave him he will take her away with a snap on the fingers? plz a need help!

Sounds like you should leave him.
Try and document every verbal or physical abuse incident to gather a file, once you are ready to leave take this with you to the police and consider pressing charges. If they are aware of the abuse then you are covering yourself legally and decreasing his chance of custody. Witnesses to these incidents would also help.

If his name is on the birth certificate, if he is the father or not, he would still be liable for the child, unless the birth certificate was changed.
Since you ahd he arne't married, you would more than likely get the child. The only way is if you had no job, and everything was in his name, but even then, you would have a chance to keep her.
You could go for sole custody, then he would have more of a fight on his hands.
I agree with documenting everything he says that is a threat to you. If he hits you or her, call the cops, get it reported. If he is a bad father, no court will award him any child.

The first issue to address here is that it sounds like you are in an abusive relationship. If he's threating you with taking your child from you if you leave, what could he do next? You need to do what one of the other people said and document EVERYTHING he says to you that could be questionable. Next, you need to find a safe place for you and your baby. No judge in their right mind is going to give sole custody to an abuser.

LEAVE HIM NOW! Is there a reason why he would get custody and not you? Most likely, if there aren't any reasons to push the judge to give your daughter to him, then the mother gets the child or it is joint custody. He is just trying to scare you to stay with him, and by what it sounds like, I don't think he really does love you...that may sound wrong, but please do not take it wrong.

If u are close with ur parents or someone who u can trust. Wait until he leaves and take ur child and leave. Don't let him know where u are. If u feel that he will act out on his threats then u need to leave. If u don't feel ur child is safe u really need to leave. Ur child being safe should be the most important thing to u. Good Luck and don't let him think that he scare u, cause then he has the power.

First off, what state do you live in? And how old is the child? Has he ever taken a paternity test?

Usually, though, if you do not take drugs, endanger your daughter, or abuse her, you are fine as long as you feed, clothe, and bathe her. Most courts would be very unwilling to take a child from their mother. Shared custody? Yes. But not take her from you.

Is he the biological father? If not, he has no rights whatsoever to the child. If he is (and this can be proven through DNA), then you need to start documenting everything he has done, including the threats to take her away. Using the child as a weapon against you will look bad in court.

get a job and support yourself however you can, so if he trys to take her away you'll have some ground to stand on infront of a judge. they usually side with the mothers especially if the father is abusive but you have to be able to show that you will provide a better life for the child

if he's listed on the birth certificate, then legally you both share custody of her. the only way to prevent him from taking her is to take him to court for a custody battle, and the judge will decide on who gets custody and who gets visitation when.

If he is not on the birth certificate, he doesn't have a prayer.

If he IS on the birth certificate, 95% of the time a court will decide in favor of the mother.
