I work in a landscape company 8 hours a day from 7:00 a.m to 3:00 p.m my employer only gives us one 15 minute break is that correct what can i do? as far as i know is, that by law an employeer has to give you at least 30 min lunch (unpaid), and two breaks (paid) if you work more than six hours a day. Is there something I can do, plus he expect us to be 15 minutes early any advise? I like my job I do not want to quit, but tha's the only thing is bugging me my lunch or break. HELP!!!

***By the way for those who think that my husband is and illegal what makes you think that? first of all he is not illegal he is a citizen of the United States. and second of all just because he works for a landscape company doesn't necessary mean he is an illegal. God I can't beleive how much discrimanation there is out there.

You can go to the Department of Labor, the company will be in violation, if the company does not give you breaks, explain to the employer that you should get them, if the employer does not agree to this, have your husband get fired, then go see a employment attorney and then you can sue the employer for wrongful termination. If you desire, send the employer an anonymous letter stating your concern, send it certified mail.

Well, technically you aren't working 8 hours because of the 15 minute break. I think you have to work 8 or more hours to get a lunch which is at least 30 minutes. Then again, the laws are different in every state. You should find out what the labor laws are in your state and go from there.

No, that's illeagal! By law, for an 8 hour shift, you're entitled to two 15 minute breaks and a 1/2 hour lunch. You could report your employer to the labor board and he'd probably be in some hot water.Another thing and please don't get offended by this, but do you have a legal right to work in this country? If you do then you need to go to the Labpr Board. If not then you shouldn't be here in the first place and you need to either keep quiet, go through the legal process or go back to your own country.

I took some business psychology in college and if I'm not mistaken (or the laws haven't changed) in an 8 hours day they must give you (your husband) 2 10 minute breaks and a half hour lunch. They don't have to pay for the half hour lunch but the breaks are paid breaks.
Contact your state labor board to find out for sure. What I learned might have just been in my state and not yours.

Labor laws require a 10 minute break for every 4 hours worked with 1/2 hour lunch break for an 8 hour day.

I'm almost positive most states require at least a 30 minute unpaid break. What state are you in? If CA, definately YES! Contact the labor board immediately. Check out this website..

You need to call your state labor board and ask them what the laws in your state are. After you hear the answer, if it sounds like the company is not abiding by the laws, ask what your next step should be.

Yes, you're right. You shoud be getting your 30 minute lunch, and 2 paid 15 minute breaks. You should go to the labour board, your boss will change his tune in a hurry.

it is not right - call a lawyer and set an appointment
unless your husband is an undocumented immigrant - then it's a whole other issue - but all humans deserve adequate working conditions - but those of illegal immigrants are not protected by the laws of the USA
