This varies from state to state. Many states have exceptions for different ages. Some states do not define statutory rape as sex among minors over a certain age. Additionally, there was a prosecutor a few years ago who began to try these cases and he was run out of town. Politically, whether you agree with it or not, I don't think that the majority of people in our society believe it is right to prosecute two 15 year olds for having sex.

The laws were designed to protect children from being preyed upon by and taken advantage of adults and older teens; however it is not limited to that.
In cases where any party involved is under the age of 12 (in nearly all states) or if someone pushes for prosecution where one party is a few years older than the other party and both are underage (say a girl 13 and a boy 16), they police and Courts will pursue those matters also.
It was not to long ago on one of the talk shows a father pushed to have his 16 year old daugther's 17 year old boyfriend prosecuted.

Statutory rape law are specifically designed to protect the underage person. Therefore, it wouldn't be logical to use it against a member of the class it was intended to protect.

statutory rape is when you have a minor and a person that isnt a minor but is more than 3 yrs apart from the minor have sex. i went through it when my dad tried to file statutory rape on my bf i was 17 he was 19 and the law said he cant bc my bf want 3 years or more older then me...

Also the important thing to mention is the underage kid is the "victim." There is no defense that they consented to sex because the court says they lack the capacity to consent to sex.
So going after the underage kids who engage in sex would be like going after mini-mart clerks to stop armed robbers.

Usually there are stipulations in the law to prevent that from happening such as in my state if the girl is under 16 the boy cannot be more then 4 years older then her.......I think statutory rape laws are stupid though...

It's sex with some under the age consent by someone who is OVER the age of consent.
Two 16 years olds - no one over the age of consent (just dumb kids)
One 16 year old and one 20 year old - one child one adult = illegal.

There are rules around that - to do with the age difference between the two individuals. It makes no sense to ruin two kids lives with a criminal charge.
