I just started a DBA(doing business as, or certificate of assumed name) in the state of Minnesota. Do I have to have both a TIN and EIN or just one or another ?Which one do I have to have if I don't need both? My business is a horse boarding facility that boards horses. I charge extra for services like bathing, walking, etc. Do I have to charge sales tax for these, or what? What do I need to stay legal and safe? I have boarding contracts and liability forms. HELP!

A TIN is a taxpayers identification number, which is basically your SSN, and can be used for business purposes if you are a sole proprietor. An EIN is an employer identification number which is only needed if you have employees. As far as the sales tax, when you register your business with the state they will send you all the information you need about charging sales tax. Another simple way to find out is to call another boarding company in your state and ask if there is sales tax on there services.

EIN and TIN are basically the same thing. You should definitely get them for your company.

You can apply online at www.irs.gov once you fill out the forms, you can print out a temporary EIN number to use.

One thought though.. with a horse boarding facility, I would imagine it to be a high liability business. In that case, you definitely should incorporate or form a business entity for protection.

Contact your local small business association. They will guide you in what the state regulations are for your business. You can use your ss# but it is not advisable due to the increasing identity theft . By calling the IRS they can give you and ein# over the phone and they answer questions of that nature. 800-829-4933. Check website. Best wishes.

No, you can use your social security number. You cant charge sales tax on labor.
