This girl he was dating gave her a picture of herself of her own free will. My dad scanned it for safe keeping on our home computer. When she found out she was furious, broke off the relationship and is now suing my dad for the pictures. Does this case have any ground or will it be thrown out of court?

With a crazy, paranoid lady like that I would just give the picture back, show her the photos being deleted off of the computer and be rid of her. There is nothing wrong with having a picture of your girl friend on your computer. I have a picture portrait of my girl friend on my computer screen. The only way I could do that is by scanning the image. There is nothing lewd about that or wrong with that.

Well - if the picture is one where is she is clad in less than "acceptable" public attire or in a compromising position I can see where she would be angry that he put it on the computer - safe keeping my left butt cheek - the only reason a picture is put on the computer is to make copies or send to someone.
So - being that she is serious enough to sue and angry enough to break off the relationship one can assume it is a compromising picture which she was an idiot to give to someone and your father is a letch for scanning on to his computer.
Here's a thought - let her delete the picture off the computer and give the damn picture back and everyone grow up.

I would need to see the picture for a full determination. Right now, I'd say he will be cool. Lawsuits ain't cheap and unless the attorney is working on a contingency - meaning he gets a portion of the winnings as pay - I doubt she'll ever go to court.

The picture was a gift to do with as he pleases.
Maybe if the picture was copyright protected, the photographer of the pic would have a case for copyright violation because your dad copied it...but I seriously doubt anything will come of this. What a freaky *****, eh?

I don't know but tell your dad to just give her the pictures back and then maybe she'll drop the law suit. Does he really want pictures of a crazy lady anyways?

She can try to sue, but it will likely be thrown out. If she gave it to him, he can do what he wishes - even distribute it, something he might want to mention if she chooses to pursue the matter. I'm assuming this picture is somewhat revealing, hmmmmm?

No if she gave it to him, that ment that she concented that he could do what he wanted w/ it, but if it was an explicit picture or something and he placed it on the internet, that may be somethign else... but if he just placed it on his hard drive then there shouldnt be any problems...

not unless he has circulated it or posted it online or exploited her in any way. if he just scanned it and saved it in a personal file she cant do anything unless she can prove that he 'stole' it.
