my daughters father has nothing to do with her but my partner of three years wants to have a legal right to her iff anything happens to me so that she will not be sent to her birth farther,

You need to speak to a reputable attorney in your area for the legal way to go about this. Contact your local Bar Association or Lawyers Association for a referral. It should not be that expensive either, depending on the issues involved it could be an adoption and if the birth father is not involved at all it wouldn't be complicated. Good luck and God Bless.

ask your daughter first, if she's old enough to make that decision, then let her. my youngest daughter lives with her mother, and god forbid anything goes wrong, but i don't think legally bound or by any other means would she come live with me, as my daughter just doesn't get along with my current partner of 13 years. if your partner wants to adopt or for your lass to use his surname then just do it. as long is its not for fraudulent reasons there isn't a problem. if he makes a good impression on assisting you in bringing her up the she most likely wouldn't want to go stay with her birth father anyway. i didn't.

As far as I know if he would like a adopt her then you have to have the permission of her father (even if he hasn't had anything to do with her).........I may be wrong but thats what I was told. You could write a will stating this though

Make him her legal guardian in your will, should sort it out, it's a simple answer, but doesn't have the problems associated with adoption.

he could legally adopt her. That will legally name him as her father and doesn't the need the permission of the biological father

Go to your local citizens advice bureau for help. They have trained people there who will tell you what you need to do.

Contact a lawyer, he has to adopt her.
