I just recently got married and my daughters want to change their last name to my new last name. Their father doesn't have custody and he only see's them when they want to go down and visit. He pays half of the child support which he was ordered to pay. He owe's over 5 grand in back child support. I want to change my girls last name, but will this interfere with the child support or ??? Please tell me how to go about this. Thanks for any help.

Your ex getting visitation only when they want to go down and see him is a way of alienating him from his children by you. If there is court ordered visitation, then you should follow it no matter what. Child support won't have anything to do with changing their names. If your ex doesn't go along with you on this, your battle will be long, expensive, and most likely will fail. I am not trying to offend.

You can not change the children's last name without permission from their father. He may not have custody of the children and is behind on his child support...but that doesn't take away his rights. He could try to avoid child support all together and still have the rights to the children....I know this because my ex owes over $40,000 in back child support. In order to change my sons last name I had my ex husband sign a letter relinquishing his rights as a parent.....as for the back child support...that is something already owed and the courts will enforce the back payments. I would strongly recommend not changing names until your wedding with this new bf not sure how but with the marriage process there should be a way to do that.Plus you don't know what the future will bring and what will happen tomorrow anything can happen in any circumstance so don't plan for tomorrow plan for today and worry about when the right time comes don't put their last name in jeopardy even if you want to change it. Let them mature and make the choice on their own when they can make the decision on their own

The only way to change their name is through the Court, however, it is with the consent of the father. Regardless if he is behind or not, he is still their father. If he relinquishes his rights and your husband adopts the girls, then you can change their name. And - Yes, this will interfere with your child support as in it will be non-existent.

You can start using another name.... just not change it officially.

As Long As It is not FRAUD....

I had this problem growing up. I just started using my stepfathers last name, entered school with the other name, even had a drivers license with his name. It was legal for me to use it since I was not trying to defraud anyone.

Switched back to my real last name after joining the Army and actually having contact with my real father.

They could use his name but it would not be "official"

Tell the ex you'll make a deal with him. In exchange for that back and future child support, he can terminate his parental rights and sign on the dotted line. If he says no, tell him ok, and you want your 5 grand now.

OH you are one of those woman that think you can wipe the slate clean and start over like you have one big happy family. Why don't you just keep the last name that your daughters have then you wouldn't have to change everything. And why should your exhusband pay to NOT have his own children in his life.

Virginia requires you to have a lawyer do a name change for minors and it is around $500. You then have to have her father sign on the dotted line becuase he is her father and you can't just change her name without his consent. I think you can lower his back child support though maybe "forgive" a little of it to leverage him to sign? Just a thought......

You cant without his permission...his lack of support will not effect a name change...the courts look at support as a completely seperate issue from visitation or parental rights.

If you have the money and permission from the Father. You cannot just start re-writing their name differently than what is written on the birth certificate. This is a government document.
