According to this Texas attorney: "You can file for divorce if you are pregnant, but the divorce cannot be finalized until the child is born. This is true so that appropriate orders may be made for support and access."

Under the US code, a divorce will be granted. Make sure that there is an order for when the baby is born, to require paternity testing for child support purposes.

KP is right, you can NOT get a divorce if the wife is pregnant. That is one of the first things you are asked during the first visit to the attorney.
