In many ways I feel it takes away our 5th ammendment right...you know the right to not incriminate yourself. "I plead the 5th", etc. But, I have been told I was wrong because you choose to work at a certain place, and it is not a right.

I think there are certain jobs that do require some random drug testing, particularly if the job involves the health and safety of others. For instance, my husband is a school bus driver, and they do random drug testing, and that's a good thing.

Yes, I believe any company has the right to know if its employees are taking any drugs that my alter their state of mind while on the job. If an employee is at risk for arriving at work under the influence of any drug (illegal or not), it compromises the safety of his/her co-workers and can cost the company lost of money in damages if the situation got out of hand.

Drug testing in general is completely unconstitutional based on the 1st Amendment right to your persons in combination with the constitutinal right to not provide evidence against yourself...
Just like in court when you have the option to decline to be a witness against yourself... a drug test is forcing you to do the opposite.

yes, i think random testing should be allowed, assuming the employees are aware of this condition upon being hired.
as for the false positive, you can always challenge a result, and request a re-test.

l think its fair in some instances like at a place of employment . But then only if it was a hazard like heavy machineary . That might be hazardous if operated under the influences of drugs.
