Hello,

My wife, whom I have been seperated from for the past seven years, and I were married in Idaho. I have lived in Oregon for the past six years. She is God knows where, presumably in Washington state. We have had no contact for the past six years. We do have a child together. She has custody of him and has not let me know her or his whereabouts in the past six years. I have tried to find her so I could watch my son grow up, but she has become unfindable.

My question is about filing for divorce from her. How can I do it if I can't serve her with papers?

What about a parenting plan? How does this work if I can't find her or my son?

At this point, I just want the marriage disolved quickly.

Any legal help would be greatly appreciated.

You file for divorce in Oregon. You try to serve her at her last known address. If none is known you serve her by "publication" in a paper in her last known area or by publishing it at the courthouse. A lawyer should be hired as there are a number of rules to follow to make sure that this is all done correctly.

Did you wife have any contacts with Oregon? Did she ever live in Oregon? Work in Oregon? The reason is that the court needs to establish jurisdiction over her. If she has never had any contact with the state - the court might grant a "status" divorce - meaning you would be legally divorced - but might not deal with property/child custody issues.

If she doesn't respond to the filing - you will get a divorce by default.

As far as parenting plans and custody - until you find your son this question is moot. You might want to try a private investigator (your lawyer may know some) and try to track him down through social security numbers, etc. They may be able to find both of them quickly.

My friend is married to a greedy low life who hasn't worked half the marriage and he now whats her retirement and spousal pay, they have been married 12 years. He wants almost everything and all he has done is gamble money away and be verbally abusive she is low key and depressed type of person, now she is afraid he will get all she has worked for 30 yrs for.Attorneys tell her she might have to give him spousal support he is 55 yrs old she is 63 any advice or any good attorneys names??? i Portland oregon

The last known address is sufficient for service of notice.
