My teacher accused me of cheating on a test. I had a study guide in my jacket pocket. is it ok for her to go into my pocket to look for a study guide etc if she only assumes im cheating.

Can teachers perform physical searches of students? "Yes!" This is a public safety issue; however, searching you for a cheat sheet would not likely fall into the public safety category.

Instead, one would wonder how she knew where your cheat sheet was if you weren't accessing it during class?

It sounds like you got caught, then were embarrassed when she proved you were cheating, and now you are trying to cop out on some illegal search plea, which school is not a court room.

Tell your parents; have a parent, teacher, student conference to discuss your concerns, but be prepared to accept the consequences when a school asst. principal or principal suspends you from school for cheating on a test. Also, you may fail the class as a consequence.

From your own description of the scenario, your case smells fishy.

As long as the study sheet was hidden out of view and you weren't trying to look at it, then no she should'nt be able to accuse you. How did she know you had it?

Please. If she knew you had a study guide in your pocket, then she saw it. If she saw it, then yes, I think she's in the right.

Unfortunately, the pathetic quality of teachers in the USA is so bad you can't get the bad ones fired. The NEA operates with virtual impunity and teachers nowadays can do damn near anything they want short of committing murder.
