A group of thugs jumped me @stabbed me my licence was suspended i used a car to get away in the process of fleeing for my life i was involved in an accedent when i turned myself in they charged me with leaving the seen and driving while suspended can i get off on self defence i have wittnesses that saw me getting attacked and the accedent was where the attack happend and if anybody knows caselaws simular to this situation that could help me please point me in the right direction thanck you very much PS.i filed a report agaist my attackers after i found out who they were

Of course you fled the scene, you'd just been stabbed. The cops can't charge you with trying to get to a hospital (I assume that's what you were doing), even if you WERE driving with a suspended license. They can charge you for the accident, but a judge should just refuse to hear the rest of it. If he doesn't, something's probably wrong with him. XD

Basically you are claiming extenuating or mitigating circumstances, that caused you to flee the scene of the accident, and to be operating a motor vehicle after suspension of your right to drive. Your first move should be to get an attorney, or Public Defender. If you can prove the attack, and you say that you have witnesses, then your attorney should be able to justify your actions, with the court.

OK you were attacked people saw you get attacked and no one did anything ..you stole a car or is it yours if yours you drove it before you were attracted if someone Else's you face grand theft too ! never heard of anything like this talk to a lawyer and why didn't you make a report right away instead of waiting to find out who attacked you ? you could have given the facts and description of attackers then ........maybe that would have helped ...good luck

I'm not too familiar with the law but I do know that if you weren't supposed to be driving in the first place and you were at a place that you physically drove to--then you're at fault.

Prosecuters are going to use the angle that had you not been driving in the first place you would've never gotten yourself into that bad situation.

Well, according to the law you "were" driving on suspension. If you don't have a lawyer talk to a public defender. Yeah, I know............public pretenders suck. You may be able to use this in your defense. But since this is only a driving offense you may not be able to get a public defender. If not contact a legal aid office in your city. They offer free legal help to those who can't afford it..................What really bites is that you may be screwed anyways. This is why you need real legal help

Prove that you left the scene due to threat from the other party and present witnesses if possible. Cite that you voluntarily reported the incident to show that you have no intention to escape from the incident.

You need to speak with your attorney. If you are being charged, and there is any possibility of jail time, the court will appoint an attorney for you if you cannot afford one.
